Terms of Service

By purchasing the services of CrissyDissy, you agree to the following Terms of Service between you the Client, and I the Artist.

1. General Terms
♦ The client, agrees they are of legal age and assumes full responsibility for any money exchanged for this service.♦ Clients will receive a full resolution .png or .jpg file of the completed Artwork. The source file will not be distributed, and no physical goods will be shipped.♦ The Illustrator reserves the right to refuse or discontinue a commission at their discretion. Upon the latter the client will be fully refunded (Detailed in a later segment)♦ Client will receive a full resolution .png file of the completed Artwork, as well as a watermarked smaller resolution .png file for internet upload. The source file will not be distributed, and no physical goods will be shipped.
2. Payment & Fees
♦ All payments are paid upfront through VGen or Stripe Invoice (within 48 hours or the project may be cancelled.) I will not start working on the project before I receive payment.♦ An exception to the above term is if Client and Illustrator have agreed on a payment plan, which is only available for services above the total of Two-Hundred (€200) EUR♦ If Client has a deadline within 2 weeks from application, a rush fee of thirty (30%) percent shall be paid♦ NDAs - Requesting your commission and the process to be offline, nothing will be posted on social media or streamed on Twitch/YouTube by the artist. Client agrees to pay a fifty (50%) percent Non Disclosure Agreement (NDA) fee.
3. Revisions
♦ During the sketch phase, the Client may ask for multiple free revisions. However if the Client and Illustrator cannot come to an agreement after 3 sketch passes, Illustrator will refund and cancel the commission.♦ Once the final Artwork has been turned in, any revisions requested that are not due to any fault on the part of the Artist (such as but not limited to forgotten details, incorrect depictions or colour adjustments), an additional fee shall be charged.
4. Usage Policy
♦ Client agrees that the Artwork will only be used for personal use. Meaning that the Artwork cannot be used for profit. This includes but is not limited to: merchandise, video or streaming assets, promotional materials, and logo creation.♦ Client agrees to not claim the creation of the Artwork as their own.♦ Client agrees to not modify the Artwork in any way that are not: Cropping or resizing the image, transparency changes, alternative colour tweaks (which is to not be passed off as the original piece) or adding text without permission from Artist.♦ You are allowed to post commissioned artwork on other websites as long as credits link back to my website or social media.♦ I reserve the right to stream the creation of the Artwork publicly, and post Works in progress (W.I.P.s) to my social media, unless asked not to. (NDA fee)♦ Client agrees that no version of the Artwork shall be used as a Non Fungible Token (NFT) or in AI datasets in perpetuity.♦ All rights not expressly granted hereunder are reserved to the illustrator. Including but not limited to all rights in sketches, mock ups, or other preliminary materials. Illustrator will not seek to resell or re-use the Artwork unless the Client breaks the terms listed above.
5. Refunds and Cancellation
♦ Refunds will not be available after the commission is finished.♦ If the client cancels the commission, refunds will be paid back depending on the amount of work that has been done:• Cancellation during the lineart stage: Sixty (60%) percent
• Cancellation during the colouring stage: Thirty (30%) percent
• Cancellation after the final work being turned in: Zero (0%) percent♦ In the event of a cancellation by the Artist, the Artist shall provide a full refund to the client of any payment that had been exchanged.♦ In the event of a cancellation of either nature, the Artist shall own all rights to the Work, and the client will not be permitted to use said Work.♦ Client agrees to not file a chargeback after the Artwork has been turned in. In the event of a chargeback, the Client loses all rights to any Artwork created, and the Artist gains the right to full profit from said Artwork.
6. Commercial Rights
♦ Commercial rights means usage of work on streams, videos and other content, any monetized instances, or selling/reselling work to another party, as a part of any product, or on another platform.♦ If Client wishes to make additional use of the Artwork outside of the initial agreement, such as commercial usage rights, Client agrees to seek permission from Illustrator and make such payments as are agreed to between parties at that time.♦ The added price is dependent on the type of commercial business you're intending to do with the artwork:• 2x price: art used for social media platforms that generate monetary profit (Twitch, YouTube, personal site),
promotional/branding purposes, and game assets.
• 3x price: art used for merchandise such as stickers, charms, t-shirt, postcards, prints etc.If you are looking for any of the above mentioned projects please contact me down below or at: [email protected]Upon commissioning me, a copy of this TOS shall be attached to your invoice for future reference.
